
Mediation and Arbitration are two different forms of Alternative Dispute Resolution. Mediation is a process in which the parties meet with a mutually selected impartial and neutral person who assists them in the negotiation of their differences. Mediations can take place before a lawsuit is filed to avoid a court proceeding. Mediations can also take place while a lawsuit is pending. By contrast, with Arbitration, the parties choose to avoid the cost and delays that can be incumbent in court proceedings (as well as the more public nature of such proceedings) and instead have the matter decided by a neutral arbitrator.
